Response to released body cam video
On 5-4-22 late in the evening a Hood County Sheriff’s Office body cam video was posted on social media.
The video is a few minutes long and does not give the full story on what’s going on in this criminal investigation.
In an effort to be transparent, I, Lt Rose would like to explain the facts of the case.
On 2-25-21 Hood County Sheriff’s Office responsed to Cook’s Children’s Hospital in Ft. Worth reference a 7-week-old baby that had a fractured skull with a stroke.
Child Abuse investigations are taken very seriously, and we utilize all our resources to see that justice is done.
We may know someone is guilty, but we must prove through hard evidence that they are indeed guilty.
This particular case has been very complicated and very frustrating for all parties involved.
Now on 10-19-21 Hood County Sheriff’s Office arrested the mother to the injured child and charged her with Tampering with Evidence felony 3 charge.
We had evidence and probable cause that the mother had deleted text messages from her cell phone pertaining to the Injury to a Child investigation.
I, Lt. Rose authorized Investigator Zamarron to make the arrest and seize any cell phone that may have evidence on it.
The body cam shown is when Investigator Zamarron interacts with the grandfather of the victim.
The Grandfather’s cell phone was considered evidence and pertinent to the investigation.
Investigator Zamarron or any police officer has a right to seize a cell phone due to probable cause, the totality of the circumstances and to prevent destruction of evidence.Police officers do not have a right to search cell phones without the owner’s consent or a search warrant.
Investigator Zamarron seized the phone from a less than cooperative Grandfather.
No one was injured and the cell phone was secured as evidence.
I stand by Investigator Zamarron and take full responsibility for his actions that I authorized as his supervisor.
Criminal investigations and police work in general can be very messy and are nothing like the cop shows on TV.
I took an oath to protect, preserve, and defend the Texas and United States Constitution and nothing Investigator Zamarron did violated that oath that he took or I took.
I hope this sheds some light on the situation and helps everyone consider both sides before jumping to conclusions that are not factual or the true.
